General Purpose

Under direction, leads and performs complex and sensitive technical, professional and confidential work required to coordinate and administer the District's Title IX program and conduct workplace investigations on allegations of sexual misconduct, unlawful discrimination and harassment, and other violations of rights, and facilitate resolutions to employee/employer conflicts, including ensuring District and campus compliance with legal requirements, responding to complaints, creating reports, making recommendations, and coordinating appropriate interim and remedial measures; performs research and analysis to develop information used in training, policies and procedures and formulates and recommends effective language, strategies and techniques; conducts investigations often focused on contested allegations that involve potential violation of the District's policies, procedures, ethics, or the law; and performs related duties as assigned.

Essential Duties & Responsibilities

The duties listed below are intended only as illustrations of the various types of work that may be performed. The omission of specific statements of duties does not exclude them from the position if the work is similar, related or a logical assignment to this class.
  1. Coordinates and administers the District's efforts to comply with and carry out its responsibility under Title V of the California Code of Regulations, Title VII of the Civil Rights Act of 1964, and Title IX of the Education Amendments of 1972; coordinates the District's response to all complaints involving sexual misconduct, harassment, and discrimination, including collaborating with Campus and District Title IX Coordinators and management on all complaints involving employees, monitoring investigations, reporting findings, identifying and addressing any patterns, and assessing effects on the District climate.
  2. Provides direction to lower-level staff and monitors work for accuracy; provides instruction/ training to staff; provides input to supervisor on employee work performance and behavior.
  3. Serves as an advisor and subject matter expert for the District to administrators, faculty, staff, students and other Title IX Coordinators on Title IX compliance, regulations, policies, and procedures, and matters related to discrimination, harassment, sexual misconduct, diversity, civil rights enforcement, gender equity, sexual violence, and complaint processing and resolution.
  4. Assists with the development, recommendation and implementation of District-wide policies regarding non-discrimination, sexual harassment prevention and Title IX compliance; interprets, applies, and ensures compliance with all local, state and federal laws, including but not limited, to Title V, Title VII, Title IX, the Clery Act, the Violence Against Women Act, and the Campus SaVE Act, and other applicable program policies, procedures, guidelines, and reporting requirements; remains current on applicable legislative decisions, trends and developments.
  5. Collaborates with District Human Resources management and other District Title IX Coordinators to develop and implement goals, objectives, and priorities for compliance with anti-harassment and discrimination laws and Title IX; monitors operational procedures and recommends improvements and modifications to enhance workflow and program effectiveness and incorporates new developments as appropriate; actively promotes the services provided and assists in determining budget needs.
  6. Coordinates, receives, investigates, analyzes, processes, and responds in a timely and equitable manner to inquiries and complaints from administrators, faculty, staff, students, and third parties including, but not limited to, complaints of alleged discrimination, harassment, sexual misconduct, stalking, dating violence, domestic violence, sexual assault, and gender identity; collaborates with District Human Resources management on all matters involving employees.
  7. Objectively and effectively oversees, coordinates, and conducts investigations of allegations and complaints of alleged unlawful discrimination, harassment, sexual misconduct, and other violations of rights, including complaints that involve employees; prepares reports and makes findings and recommendations related to applicable laws and legal precedence; ensures investigations are timely, impartial, and thorough and conducted in a trauma-informed manner; appears in court as necessary.
  8. Formats, proofreads, analyzes, and synthesizes investigation reports related to Title IX, unlawful discrimination and harassment, misconduct, employment contract violations, and other issues and provides guidance and support to decision makers in summarizing conclusions drawn from investigative findings for administrative determination letters in conformance with federal regulations, established procedures, policies, and standards.
  9. Works with assigned investigators and third-party neutral factfinders to maintain detailed logs of investigation and prepares summaries for inclusion in Title IX and unlawful discrimination investigation reports; prepares preliminary responses to formal and informal Title IX complaints by summarizing sexual harassment allegations and general correspondence.
  10. In consultation with District Human Resources management, makes recommendations and coordinates appropriate interim and remedial measures; develops resolution for complex harassment and discrimination cases; provides information and assistance to individuals including the reporting party, accused party, or a third party about reporting options, policies, procedures, rights, and resources available at the District and in the community.
  11. Identifies, develops, prepares, and compiles critical information and responsive documents of a highly sensitive and confidential nature for Board review closed session and in response to complaints of alleged discrimination from DFEH, EEOC and other external governmental agencies; consults and collaborates with legal counsel on legal matters and judicial processes and proceedings and supplies technical information to support the District's interests; prepares resolutions and appropriate documentation following Board meetings and sends to appropriate parties as required.
  12. Oversees, maintains and conducts training on the Title IX and Staff/Student Conduct software and database to organize, manage, and track incidents; maintains investigatory files, grievance files, disposition reports, and other records regarding harassment and discrimination cases; ensures that documentation of complaint, investigation, adjudication, appeal, and sanctions are thorough and kept confidential within the specific standards and timeframes pursuant to California Community College policies and procedures, or applicable laws.
  13. Collaborates with District Human Resources management and other District Title IX Coordinators to develop and implement training and development programs and employee orientation programs to meet the needs of personal, professional, and organizational development related to anti-harassment and discrimination and Title IX compliance and best practices.
  14. Develops, coordinates, recommends, tracks, and provides initial and ongoing outreach and training to District and college administrators, faculty, staff, and students; may participate in administrator, faculty, staff and student orientation activities.
  15. Collaborates and coordinates with various departments within the District regarding anti-harassment and discrimination and Title IX matters such as with the college or District's Public Information Office when sensitive information needs to be released and with the District Police Department to report complaints defined as crimes under the Clery Act or those that may be subject to the Clery Act-required emergency notification; collaborates and coordinates with outside agencies such as high school dual enrollment partners when overlapping compliance is needed.
  16. Participates in the District's collective bargaining process by researching and collecting data/information, making recommendations on District proposals and providing input to contract language; maintains official records of bargaining sessions; conducts research and analysis in relation to disciplinary actions, investigations, and other employee relations matters; assists with union contract compliance issues; responds to inquiries related to labor relations matters; collects data, makes recommendations, and suggests corrective action if necessary.
  17. Represents the District and participates in state and national program training and development and professional group meetings; makes presentations to various groups within the District, other educational institutions, community organizations, and governmental agencies.
  18. Serves on or leads committees, work groups, and task forces; attends meetings and works collaboratively with other District Title IX Coordinators, Campus Title IX Coordinators, and all District and third-party investigators.

OTHER DUTIES
  1. Demonstrates sensitivity to and understanding of historically minoritized groups and participates in professional development activities to increase cultural competency to enhance equity-minded practices within the District.
  2. Reviews, evaluates and revises relevant Board Policies and Administrative Regulations; recommends updates where warranted, proofreads and prepares final changes; ensures that Board agenda items and supporting documents are developed, prepared and forwarded within District timelines and legal requirements and guidelines.
  3. Maintains and updates the District's Title IX website and collaborates and coordinates with Campus Title IX Coordinators to ensure their Title IX reporting and resource information on the college website is accurate and current.
  4. Performs related duties as assigned.

  1. Coordinate and administer a comprehensive anti-harassment and discrimination & Title IX compliance program, including developing and implementing goals, objectives and priorities and actively promoting the services provided, using a high level of independent judgement and personal initiative.

EDUCATION AND EXPERIENCE

Graduation from an accredited college or university with a bachelor's degree in human resources, law, personnel/public/business administration, or a related field, and at least four years of progressively responsible experience in the public or private sector in human resources, performing investigations, or related experience; or an equivalent combination of training and experience.

Experience in harassment, discrimination or sexual assault investigations preferred.

LICENSES, CERTIFICATES AND OTHER REQUIREMENTS

A valid California driver's license and the ability to maintain insurability under the District's vehicle insurance program.

Within 6 months of hire, obtain certification as a Title IX Level 1 Coordinator and Office of Civil Rights (OCR) Level 1 Investigator and maintain certification through continued annual trainings.
